These Terms of Service ("Terms") apply to your use of the website https://green-english.online and the educational services provided by E GREEN & T GREEN (ABN 22 872 790 390), trading under the registered business name "Green English". By accessing or using any part of our services, you agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy.

1. Legal Compliance

Green English complies with the Australian Consumer Law (ACL) and the Privacy Act 1988 (Cth), including the Australian Privacy Principles (APPs). Nothing in these Terms limits your rights under applicable law.

2. Enrolment and Age Restriction

Services are available only to individuals aged 18 and over. If you are under 18, you must have parental or guardian consent to enrol.

By enrolling in a course, you enter into a legally binding agreement with Green English. It is your responsibility to read and understand all applicable policies, including these Terms, Privacy Policy, and Fee Schedule.

3. Services and Platforms

Green English provides live and asynchronous English language instruction through online platforms such as Zoom, Microsoft Teams, Telegram or WhatsApp. Enrolments are open year-round, and courses commence upon granting access to learning materials or platforms.

We may add, modify, or discontinue services and features without prior notice.

4. Code of Conduct

Students must behave respectfully toward instructors and peers. Disruptive or inappropriate conduct may result in suspension or exclusion. Students are expected to participate actively and complete assignments on time.

5. Fees and Billing

All services must be prepaid. Payment may be made via Stripe by credit/debit card or bank transfer in AUD. All pricing is inclusive of GST (if applicable).

You may choose between:

  • Subscription-based payments: billed every 4 weeks (28 days);
  • Pay-per-unit: flexible payments based on lesson quantity or schedule.

Students are responsible for maintaining accurate billing details. Green English reserves the right to decline or cancel enrolments at its discretion.

6. Cancellations, Absences, and Rescheduling

Students are entitled to a 14-day break per calendar year without charge, provided advance notice is given.
Missed group classes beyond the 14-day break are chargeable.
One-on-one classes may be rescheduled free of charge with at least 24 hours' notice. Late cancellations are non-refundable.

7. Subscription Cancellation and Notice Period

Subscription cancellations require a minimum notice period of four (4) weeks from the date of notice. This means that access to classes and services will continue for four (4) weeks after the cancellation request is submitted.

If the notice period extends beyond the current billing cycle, the subscription will automatically renew for the next billing period to ensure uninterrupted access to services.

In such cases, any portion of the renewed billing period that falls outside the four (4) weeks notice period will be refunded on a pro-rata basis.

For clarity, the notice period always begins on the date the cancellation request is received, regardless of the billing cycle date.

Example: If a cancellation request is submitted with two weeks remaining in the current billing cycle, the subscription will renew for the next billing period. The user will continue to have access for four (4) weeks from the notice date, and any unused portion of the renewed period will be refunded accordingly.

Exceptions. The notice period may be waived in cases of exceptional circumstances at our discretion.

8. Refunds and Transfers

We do not offer refunds for change of mind, early withdrawal, or unused services. However, your rights under the Australian Consumer Law remain unaffected.

Course transfers are permitted. Any funds paid will be applied as credit toward the new program. No refund is provided for price differences.

9. Use of Content

All course materials, recordings, and study notes are protected by copyright. These materials may only be used for personal learning by enrolled students. Redistribution or reproduction is prohibited without written permission.

10. Privacy and Personal Information

We handle personal data in accordance with our Privacy Policy. Sensitive information is encrypted and accessible only to authorised staff. Payment data is processed securely via Shopify.

You may request access to or correction of your personal data. Deletion of data held by external providers is subject to their policies.

11. Third-Party Services

We use third-party platforms (e.g., Zoom, Mailjet, Telegram). We are not liable for issues arising from their services. Use of such platforms is at your own risk.

12. Limitations of Liability

Our services are provided "as is." We do not warrant uninterrupted or error-free access. To the maximum extent permitted by law, Green English is not liable for indirect or consequential damages.

Nothing in these Terms excludes your rights under the Australian Consumer Law, including remedies for major failures.

13. Indemnity

You agree to indemnify Green English and its personnel from any claims arising from your breach of these Terms or misuse of the services.

14. Termination

We may suspend or terminate access to services for violation of these Terms. You remain liable for any unpaid fees up to the termination date.

15. Complaints

To lodge a complaint, please contact us at contact@green-english.online. If not satisfied, you may escalate privacy complaints to the OAIC or consumer complaints to the ACCC.

16. Changes to Terms

We may update these Terms from time to time. Any changes will take effect upon publication on our website. Continued use constitutes acceptance of the revised Terms.
